Exemption from pension insurance in the KSK: what the law provides

Whether members of the artists’ social insurance can be exempted from pension insurance, which cases §4 KSVG lists as free of it, what applies when drawing an old-age pension and which exemptions concern health and care insurance — in the words of the KSVG, SGB VI and the Künstlersozialkasse.

Compulsory insurance in three branches

§1 KSVG: „Selbständige Künstler und Publizisten werden in der allgemeinen Rentenversicherung, in der gesetzlichen Krankenversicherung und in der sozialen Pflegeversicherung versichert, wenn sie 1. die künstlerische oder publizistische Tätigkeit erwerbsmäßig und nicht nur vorübergehend ausüben und 2. im Zusammenhang mit der künstlerischen oder publizistischen Tätigkeit nicht mehr als einen Arbeitnehmer beschäftigen, es sei denn, die Beschäftigung erfolgt zur Berufsausbildung oder ist geringfügig …“ (Self-employed artists and publicists are insured in pension, health and care insurance if they work artistically or as publicists on a commercial and not merely temporary basis and employ no more than one employee for it, unless for training or in a minor job.) Pension law takes this up: §2 Satz 1 Nr. 5 SGB VI makes compulsorily insured „Künstler und Publizisten nach näherer Bestimmung des Künstlersozialversicherungsgesetzes“.

No exemption from pension insurance

In its FAQ the Künstlersozialkasse writes: „Die Rentenversicherung nach dem Künstlersozialversicherungsgesetz (KSVG) ist eine Pflichtversicherung, d. h. eine Befreiung von der gesetzlichen Rentenversicherungspflicht sieht das Gesetz nicht vor, ist also nicht möglich.“ (Pension insurance under the KSVG is compulsory; the law provides no exemption, so it is not possible.)

On its page „Ausnahmen“ (exceptions) it adds: „Befreiungsmöglichkeiten von der Rentenversicherungspflicht sieht das KSVG nicht vor, und zwar auch dann nicht, wenn eine anderweitige Absicherung z. B. durch einen Lebensversicherungsvertrag bereits besteht.“ (Not even if other cover, for example a life-insurance contract, already exists.) Under the heading „Besonderheit für Publizisten aus den neuen Bundesländern“ (publicists from the eastern states) it also says: „Eine vor dem 01.01.1992 ausgesprochene Befreiung von der Rentenversicherungspflicht aufgrund des Gesetzes über die Sozialversicherung (SVG) behält ihre Gültigkeit.“ (An exemption from compulsory pension insurance granted before 1 January 1992 under the former GDR’s Social Insurance Act remains valid.)

Free of insurance under §4 KSVG

An exemption (Befreiung) has to be applied for; freedom from insurance (Versicherungsfreiheit) applies by law. §4 KSVG begins: „In der gesetzlichen Rentenversicherung ist nach diesem Gesetz versicherungsfrei, wer“ (free of statutory pension insurance under this law is anyone who) — and then lists seven cases, quoted here in the original:

Whether one of these cases applies depends on the circumstances. For example, what membership of a professional pension scheme (berufsständische Versorgungseinrichtung, §6 SGB VI) through another activity means for the artists’ social insurance is answered by the Künstlersozialkasse or the Deutsche Rentenversicherung.

Old-age pension: what the Künstlersozialkasse writes

In its leaflet „Künstlersozialversicherung und Altersrente“ the Künstlersozialkasse distinguishes by type of pension:

On health and care insurance it writes: „Wer neben dem Rentenbezug weiterhin die künstlerische oder publizistische Tätigkeit erwerbsmäßig ausübt, verbleibt in der Kranken- und Pflegeversicherung bei der KSK … Die Art der Altersrente spielt keine Rolle.“ (Anyone who keeps working artistically on a commercial basis stays in KSK health and care insurance; the type of pension does not matter.) And on the annual report: „Der Zahlbetrag der Rente ist nicht in die Einkommensmeldung an die KSK einzubeziehen.“ (The pension paid is not included in the income report to the KSK.) The Künstlersozialkasse needs, according to the leaflet, „eine Fotokopie des Rentenbescheides (die erste und zweite Seite … reichen aus)“ (a copy of the pension notice; the first and second pages are enough).

Waiving the freedom from insurance

The second half of §4 Nr. 5 KSVG leaves a way back into pension insurance: „das gilt nicht, wenn durch schriftliche Erklärung gegenüber der Künstlersozialkasse auf die Versicherungsfreiheit verzichtet wird; der Verzicht kann nur mit Wirkung für die Zukunft erklärt werden und ist für die Dauer der selbständigen künstlerischen oder publizistischen Tätigkeit bindend“ (this does not apply if the freedom is waived by written declaration to the Künstlersozialkasse; the waiver works only for the future and binds for as long as the self-employed artistic work continues).

The Künstlersozialkasse’s form for this declaration contains the sentence: „Mir ist bekannt, dass mein Verzicht für die Dauer der künstlerischen / publizistischen Tätigkeit bindend und eine Rücknahme nicht möglich ist.“ (I am aware that my waiver is binding for the duration of the artistic work and cannot be withdrawn.)

Exemptions in health and care insurance: §6 and §7 KSVG

The exemptions in §6 and §7 KSVG concern health insurance — and with it care insurance — not pension insurance.

On care insurance the Künstlersozialkasse writes on its page „Ausnahmen“: „Als Folge der Befreiung von der gesetzlichen Krankenversicherungspflicht tritt in der Regel gleichzeitig die Befreiung von der gesetzlichen Pflegeversicherung ein.“ (An exemption from health insurance as a rule brings an exemption from care insurance with it.) And on the §7 exemption: „Mit der Befreiung tritt gleichzeitig die Versicherungsfreiheit in der gesetzlichen Pflegeversicherung ein.“ (With the exemption, freedom from statutory care insurance applies at the same time.)

Do old-age pensioners stay insured through the KSK?
In health and care insurance yes, if the work continues on a commercial basis; according to the Künstlersozialkasse the type of pension does not matter. In pension insurance, §4 Nr. 5 KSVG makes free of insurance anyone drawing a full old-age pension after the end of the month in which they reached the standard retirement age. With a partial pension or an old-age pension before that age, pension insurance continues, according to the Künstlersozialkasse.
Can you keep paying into pension insurance with a full pension?
Under §4 Nr. 5 KSVG the freedom from insurance can be waived by written declaration to the Künstlersozialkasse. The waiver works only for the future and binds for as long as the self-employed artistic or publicist work continues.
